I'm horrified to hear how the system, there to support the vulnerable, disabled people are losing their rights to a dignified life, comforts we take for granted.
I feel we can only judge the humanity of our society by the way vulnerable individuals are supported.
I've been to ESA tribunals, DLA,A.A tribunals as a Welfare Rights Representative, I still do despite being retired.
I would urge that a client never attends a tribunal without support...even if it's just a friend. See if you can get written help from somewhere like a Law For All Centre, C.A.B or Welfare Rights. Gather supporting letters, or any other information you can muster to take to a tribunal. Break down the facts that have been given, regarding why you haven't been allowed the benefit in question then give your own supporting evidence.
Say how your difficulties affect you on the worst days; include mental health problems as these count in the points system.
I would suggest that you actually break down your evidence into a point by point way.
1. Get someone to measure how you walk, yards walked..do you feel pain on walking.
2.Medication taken....look at your prescription...then break down why you take this medicine/tablet...what are the side effects...would your life be put at risk if you forgot to take it.
3.Communication...filling in forms, using the telephone, asking for help. I don't mean to be insulting but if your depressed/anxious/in pain then your not going to be in the best place to complete these forms.
4. Never, ever leave blank spaces on these forms because you think you have answered this particular question before.
5 Always photo-copy everything.
If a doctor asks you a question, and you don't understand what he is saying, ask him to explain.
6. Please don't be too embarrassed and include all your problems.
